NAIROBI__Miguna Miguna has been denied entry into the country after he refused to apply for a visa that grants him legal stay in Kenya.

Immigration officials have barred the self-declared NRM General from exiting the airport clearance area unless he applies for the visa.

A source at the airport says Miguna has forced his way past immigration clearance area after a heated exchange but has again been barred at the luggage area.

He arrived at 2.30om from Toronto, Canada where he was deported on February 5 via Emirates EK19.

None of the high-ranking opposition leaders is at the airport to receive Miguna.

However, Miguna's lawyers Nelson Havi and Cliff Ombeta are at the airport.

Some officials from the KNCHR are also within to facilitate his clearance.

Miguna was deported to Canada on February 6 after a dramatic arrest and detention for his role in the mock swearing-in of Nasa leader Raila Odinga as the People's President.

He has been vocal about the rights of the people and the "despot" that President Uhuru Kenyatta is but Raila and Uhuru have since signed a peace and unity deal.

The self-styled NRM General, who was still held up at JKIA's International Arrivals lounge by press time, said applying for the Visa would take away his rights.

"There is no way I will agree to what they are asking because what it does is that it waives rights that will never be restored. I know the mischief," Miguna said.

He said the Immigration department was acting against a court order issued by Justice Luka Kimaru on February 15.

The orders were that immigration should provide him with alternative travel document or allow him enter Kenya on a Canadian passport.

"I will not fall into the trick. If I was advising a client as an immigration lawyer, I would not do it. So why should I do it for myself?" Miguna posed.

Foreigners who enter Kenya on tourist Visas cannot enjoy certain privileges including participating in political activities.

Miguna arrived into the country on Monday aboard an Emirates flight and was denied entry owing to the visa debacle.

His lawyers Nelson Havi, Julie Soweto, and John Khaminwa were at the airport to the facilitate his entry.
