Justice Mohamed Ibrahim will act as Supreme Court president following the exit of Willy Mutunga.

Dr Mutunga made his final address at the court Thursday afternoon before leaving the premises.

Before his exit, he said Justice Ibrahim would administer matters of the Supreme Court, Justice Paul Kariuki would oversee Court of Appeal issues while Justice Richard Mwongo will be in charge of the High Court.

In an earlier ruling on the retirement age dispute involving Deputy Chief Justice (DCJ) Kalpana Rawal and Justice Philip Tunoi, CJ Mutunga dismissed a plea to extend by 21 more days their terms of employment.

Two Supreme Court judges --Justice Jackton Ojwang and Justice Njoki Ndung'u--skipped the session.

The CJ, Justice Ibrahim and Justice Smokin Wanjala said the court lacked jurisdiction to entertain the application.

They said the court had pronounced its verdict that there was a conflict of interest in the retirement dispute, "since all the five judges of the Supreme Court had made public their opinions regarding the retirement age."

The three judges said they had decided on the matter and could not revisit it and "that the Court of Appeal verdict stands."
