Ugandan Man jailed 9 months for peeping at girls

MPIGI, Uganda--Allan Busagwa had on several occasions sneaked a peek into the girls' bathroom at Green Valley Model Primary School in Buwama Town in Mpigi District.

His sins, however, finally caught up with him when he peeked into a bathroom where Primary Six pupils were bathing. "They alerted one of the teachers who immediately ran after him," Ms Margaret Nabakka, the director of the school said.

Following his appearance in court, the Magistrate's Court in Buwama sentenced Busagwa to nine months in Buwama Prison for criminal trespass. The prosecution led by Mr Samuel Owino, asked the magistrate to give Busagwa a deterrent sentence saying, in all court proceedings, he failed to apologise and exhibited arrogance.

Buwama Grade Two Magistrate George Musafu Kibaba said in his ruling that all witnesses had given corroborative testimonies implicating Busagwa.

When asked to defend himself, the accused, who stays 400 metres away from the school, opted to remain silent but later feigned insanity although he failed to prove it in court.

What is trespass?

Any person who, (a) enters into or upon property in the possession of another with intent to commit an offence or to intimidate, insult or annoy any person; or (b) having lawfully entered into or upon such property remains there with intent thereby to intimidate, insult or annoy any person or with intent to commit any offence, commits the misdemeanour termed criminal trespass and is liable to imprisonment for one year.

Insanity

A person is not criminally responsible for an act or omission if at the time of doing the act or making the omission he or she is through any disease affecting his or her mind incapable of understanding what he or she is doing or of knowing that he or she ought not to do the act or make the omission.
